3. COOKIES AND SIMILAR TECHNOLOGIES

NRG Cards and third parties that provide services to us may use cookies and similar technologies.

Cookies are small data files placed on or associated with your browser or device.

These technologies may be used to:

  • keep the Site functioning properly;
  • remember preferences;
  • maintain shopping-cart functionality;
  • maintain login sessions;
  • understand Site usage;
  • measure Site performance;
  • prevent fraud;
  • analyze traffic;
  • improve the Services;
  • measure marketing campaigns; and
  • provide or measure advertising, where applicable.

Some cookies are necessary for operation of the Site, while others may be used for analytics, functionality, or advertising.

Your browser may allow you to block or delete cookies. Blocking certain cookies may affect the functionality of the Site.

Where required by applicable law, NRG Cards will provide additional choices regarding non-essential cookies and similar technologies.

4. ANALYTICS AND ADVERTISING TECHNOLOGIES

We may use third-party analytics, marketing, and advertising services to understand Site usage, measure marketing effectiveness, improve our Services, and advertise NRG Cards.

These providers may collect information about your browser, device, Site interactions, and other online activity through cookies, pixels, or similar technologies.

Depending upon the technologies NRG Cards uses from time to time, these services may include analytics platforms, search advertising services, social-media advertising platforms, email-marketing providers, or similar services.

Some privacy laws may characterize certain disclosures of personal information for cross-context behavioral advertising or targeted advertising as “sharing,” “selling,” or targeted-advertising processing even where NRG Cards does not receive money in exchange for personal information.

Where applicable law provides an opt-out right for these activities, NRG Cards will provide a method for exercising that right.

5. HOW WE DISCLOSE INFORMATION

NRG Cards may disclose personal information to the following categories of recipients when reasonably necessary for the purposes described in this Privacy Policy.

Service Providers

We may disclose information to vendors and service providers that assist with:

  • website hosting;
  • ecommerce operations;
  • payment processing;

  • email delivery;
  • text messaging;
  • customer support;
  • cloud storage;
  • cybersecurity;
  • fraud prevention;
  • analytics;
  • marketing;
  • advertising;
  • accounting;
  • legal services; and
  • other business operations.

These companies may process personal information on our behalf or pursuant to their own applicable terms and privacy obligations.

Payment Providers

Information necessary to complete transactions may be provided directly to payment processors, financial institutions, or payment platforms.

Shipping and Delivery Providers

We may provide information such as your name, shipping address, email address, or telephone number to carriers and delivery providers as necessary to deliver orders.

Professional Advisors

We may disclose information to attorneys, accountants, insurers, auditors, consultants, financial institutions, and other professional advisors where reasonably necessary.

Legal and Safety Purposes

We may disclose information when we reasonably believe disclosure is necessary to:

  • comply with applicable law;
  • respond to a subpoena, court order, warrant, or other lawful process;

Business Transactions

If NRG Cards is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction, information may be disclosed or transferred as part of that transaction, subject to applicable law.

6. SALE OR SHARING OF PERSONAL INFORMATION

NRG Cards does not sell personal information for money as part of its ordinary business operations.

However, certain privacy laws define “sale” or “sharing” more broadly than an exchange of information for money. For example, disclosures involving certain advertising, analytics, cookies, or tracking technologies may potentially constitute a “sale,” “sharing,” or processing for targeted advertising under applicable law.

If NRG Cards engages in activity that is legally considered a sale, sharing, or targeted-advertising processing and applicable law provides you with an opt-out right, we will provide an appropriate mechanism through which eligible consumers may exercise that right.

NRG Cards does not knowingly sell or share the personal information of individuals under 16 years of age in circumstances requiring affirmative authorization under applicable law.

7. EMAIL AND MARKETING COMMUNICATIONS

If you subscribe to NRG Cards marketing communications, including the NRG Opening Bell or other promotional communications, we may use your contact information to send those communications.

You may unsubscribe from promotional emails by using the unsubscribe mechanism contained in the communication.

Even if you unsubscribe from promotional communications, we may continue sending non-promotional messages reasonably necessary to your relationship with NRG Cards, including order confirmations, shipping notices, transaction communications, security alerts, and responses to customer-service requests.

8. TEXT MESSAGES

If NRG Cards offers text-message marketing or notification services, participation will be subject to any additional terms and consent disclosures presented when you enroll.

Where required by law, marketing text messages will be sent only after obtaining the appropriate consent.

You may withdraw consent to marketing text messages using the opt-out instructions provided with those messages.

Consent to receive marketing text messages is not a condition of purchasing goods or services unless expressly permitted by applicable law.

9. DATA RETENTION

NRG Cards retains personal information for as long as reasonably necessary to fulfill the purposes for which it was collected, including to:

  • complete transactions;
  • maintain customer accounts;
  • provide Services;
  • maintain business and accounting records;
  • comply with tax obligations;
  • resolve disputes;
  • prevent fraud;
  • enforce agreements;
  • maintain security;
  • comply with applicable laws; and
  • establish, exercise, or defend legal claims.

Retention periods vary depending upon the nature of the information, the purpose for which it was collected, legal requirements, and legitimate business needs.

When personal information is no longer reasonably necessary, we may delete, anonymize, aggregate, or otherwise dispose of it in accordance with our practices and applicable law.

10. DATA SECURITY

NRG Cards uses reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, acquisition, loss, misuse, alteration, or disclosure.

However, no website, electronic transmission, network, database, or storage system can be guaranteed to be completely secure.

Accordingly, NRG Cards cannot guarantee the absolute security of information transmitted to, from, or through the Services.

You are responsible for protecting passwords and other account credentials under your control and should notify us promptly if you believe your account or information has been compromised.

11. THIRD-PARTY WEBSITES AND SERVICES

The Services may contain links to websites, social-media platforms, payment services, shipping providers, marketplaces, or other services operated by third parties.

NRG Cards does not control the privacy or security practices of those third parties.

Your interactions with third-party services are governed by the privacy policies and terms of those third parties. We encourage you to review those policies before providing personal information.

12. SOCIAL MEDIA

NRG Cards may maintain accounts or pages on third-party social-media platforms.

If you interact with NRG Cards through a social-media platform, the platform may collect and process information according to its own privacy policy.

Information you make publicly available through social media may be visible to NRG Cards and other users.

13. CHILDREN'S PRIVACY

The Services are intended for a general audience and are not directed to children under 13.

NRG Cards does not knowingly collect personal information online from children under 13 in a manner subject to the Children's Online Privacy Protection Act without legally required parental consent.

If we learn that we have collected personal information from a child under 13 in violation of applicable law, we will take reasonable steps to delete the information.

If you believe a child has provided personal information to NRG Cards inappropriately, please contact us using the information provided below.

Parents and guardians are encouraged to supervise minors' online purchasing, selling, trading, and account activity.

14. YOUR PRIVACY CHOICES

Depending upon where you reside and applicable law, you may have certain rights regarding your personal information.

These rights may include the right to:

  • withdraw consent where processing is based upon consent; and
  • appeal certain decisions concerning privacy-rights requests where applicable.

These rights are not absolute and may be subject to exceptions under applicable law.

For example, NRG Cards may need to retain information necessary to complete transactions, maintain legally required records, detect fraud, protect legal rights, or comply with applicable laws.

15. SUBMITTING A PRIVACY REQUEST

To submit a privacy-related request, contact NRG Cards using the contact information provided in the Contact Us section below or through any privacy-request mechanism made available on the Site.

Please clearly describe your request.

We may need to verify your identity before processing certain requests. Verification helps protect customers against fraudulent or unauthorized requests concerning their personal information.

We will use information submitted for verification only as reasonably necessary to verify and process the request or as otherwise permitted by law.

Where applicable law permits an authorized agent to submit a request on your behalf, we may require evidence that the agent is authorized to act for you and may require additional verification.

NRG Cards will not unlawfully discriminate against you for exercising applicable privacy rights.

16. UNITED STATES STATE PRIVACY RIGHTS

Certain U.S. states provide residents with additional privacy rights.

Depending upon your state of residence, the nature of NRG Cards' activities, and whether applicable statutory thresholds are met, you may have rights concerning access, correction, deletion, portability, targeted advertising, profiling, sale or sharing of personal information, or other processing activities.

NRG Cards will honor privacy rights required by laws applicable to NRG Cards.

Nothing in this Privacy Policy is intended to provide rights beyond those required by applicable law unless NRG Cards expressly chooses to provide such rights.

17. CALIFORNIA PRIVACY DISCLOSURES

California residents may have additional rights under California privacy laws, including the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”), where the CCPA applies to NRG Cards.

Subject to applicable law, those rights may include:

  • the right to know the categories of personal information collected;
  • the right to know the sources from which personal information is collected;
  • the right to know the purposes for collecting, using, selling, or sharing personal information;
  • the right to know categories of third parties to whom information is disclosed;
  • the right to request specific pieces of personal information;
  • the right to request deletion;
  • the right to request correction;
  • the right to opt out of certain sales or sharing;
  • the right to limit certain uses and disclosures of sensitive personal information where applicable; and
  • the right not to receive discriminatory treatment for exercising applicable CCPA rights.

NRG Cards will provide any additional notices, disclosures, request mechanisms, or opt-out mechanisms required if and when those requirements apply to its activities.

18. GLOBAL PRIVACY CONTROL AND BROWSER SIGNALS

Certain browsers and browser extensions allow users to transmit privacy preference signals, including the Global Privacy Control (“GPC”).

Where NRG Cards is legally required to recognize a qualifying browser-based opt-out preference signal, we will process supported signals in accordance with applicable law.

Because technologies and legal requirements concerning browser privacy signals continue to evolve, our practices may change over time.

19. DO NOT TRACK

Some browsers provide a “Do Not Track” (“DNT”) setting.

Because there is not a universally accepted standard governing all responses to DNT signals, the Site may not respond to traditional DNT signals unless required by applicable law.

This provision does not affect our obligation to honor legally recognized opt-out preference signals where required.

20. INTERNATIONAL VISITORS

NRG Cards is based in the United States, and the Services are primarily intended for users in the United States unless otherwise indicated.

If you access the Services from outside the United States, information may be transferred to, stored in, or processed in the United States or other jurisdictions in which our service providers operate.

Privacy and data-protection laws in those jurisdictions may differ from those in your country.

If NRG Cards expands its operations into jurisdictions requiring additional privacy disclosures or safeguards, this Privacy Policy may be supplemented accordingly.

21. AGGREGATED AND DE-IDENTIFIED INFORMATION

NRG Cards may create aggregated, statistical, or de-identified information that does not reasonably identify an individual.

We may use such information for lawful purposes, including analytics, market research, business planning, product development, inventory management, market analysis, and improving the Services.

Where applicable law regulates de-identified information, we will maintain and use it in accordance with applicable requirements.

22. FRAUD PREVENTION AND TRANSACTION SECURITY

Because NRG Cards buys, sells, and trades collectibles that may have substantial value, we may use information reasonably necessary to identify, investigate, or prevent:

  • fraudulent purchases;

  • unauthorized account access;
  • chargeback abuse;
  • shipping fraud;
  • misrepresentation of ownership;
  • attempted scams; and
  • other unlawful or abusive conduct.

We may preserve relevant records and disclose information to payment providers, shipping companies, insurers, law enforcement, professional advisors, or other appropriate parties when reasonably necessary and legally permitted.

23. CHANGES TO THIS PRIVACY POLICY

NRG Cards may update this Privacy Policy periodically to reflect changes in our Services, business practices, technologies, vendors, or legal requirements.

When we update this Privacy Policy, we will revise the “Last Updated” date at the top of the policy.

If required by applicable law, we will provide additional notice or obtain consent before materially changing how previously collected personal information is used.

We encourage you to review this Privacy Policy periodically.
