NRG Cards Submission Terms

These Submission Terms (“Submission Terms”) govern the submission of sports cards, trading cards, memorabilia, collectibles, and related items (“Items”) to NRG Cards (“NRG Cards,” “NRG,” “we,” “us,” or “our”) for evaluation, purchase, trade, or another transaction expressly offered by NRG Cards.

These Submission Terms supplement the NRG Cards Terms of Service and Privacy Policy.

By submitting information about an Item, requesting an offer, delivering or shipping an Item to NRG Cards, accepting an NRG Cards offer, or otherwise participating in the submission process, you acknowledge that you have read and agree to these Submission Terms.

If you do not agree to these Submission Terms, do not submit Items to NRG Cards.

1. PURPOSE OF A SUBMISSION

NRG Cards may allow individuals to submit Items for:

  • a potential cash purchase by NRG Cards;
  • a potential trade with NRG Cards;
  • trade credit;
  • evaluation for a potential transaction; or
  • another transaction specifically offered by NRG Cards.

Submitting an Item or information concerning an Item does not obligate NRG Cards to purchase, trade for, evaluate, or make an offer on the Item.

NRG Cards may decline any submission in its discretion, subject to applicable law.

2. ELIGIBILITY TO SUBMIT ITEMS

You must be at least 18 years old and legally capable of entering into a binding transaction with NRG Cards.

A person under 18 may submit or transfer an Item only through a parent or legal guardian who accepts responsibility for the transaction.

By submitting an Item, you represent that you have the legal capacity and authority to enter into the proposed transaction.

3. OWNERSHIP OF SUBMITTED ITEMS

By submitting an Item to NRG Cards, you represent and warrant that:

  • you are the lawful owner of the Item or have full legal authority from the owner to sell or trade it;
  • you have the unrestricted right to transfer ownership of the Item;
  • the Item is not stolen;
  • the Item was not obtained through fraud or other unlawful conduct;
  • the Item is not subject to a lien, security interest, ownership dispute, or other claim by another person;
  • no other person has a superior ownership interest in the Item; and
  • transferring the Item to NRG Cards will not violate any applicable law or contractual obligation.

NRG Cards may request identification, proof of ownership, purchase records, provenance, certification information, or other documentation reasonably necessary to verify ownership or protect against fraud.

4. ACCURACY OF SUBMISSION INFORMATION

You agree to provide accurate and complete information regarding Items submitted to NRG Cards.

This may include:

  • player or subject;
  • year;
  • manufacturer;
  • product;
  • set;
  • card number;
  • parallel or variation;
  • serial numbering;
  • autograph information;
  • memorabilia or patch information;
  • grading company;
  • grade;
  • certification number;
  • condition;
  • known defects;
  • alterations;
  • asking price;
  • photographs; and
  • any other information reasonably requested by NRG Cards.

You must not knowingly conceal or misrepresent information that could materially affect an Item's authenticity, condition, ownership, identity, or value.

5. PHOTOGRAPHS AND PRELIMINARY EVALUATIONS

NRG Cards may provide an initial estimate, indication of interest, or preliminary offer based on photographs, videos, descriptions, certification information, or other information submitted electronically.

Any such preliminary evaluation is subject to physical inspection of the actual Item unless NRG Cards expressly states otherwise in writing.

Photographs may not reveal all defects, alterations, surface issues, damage, authenticity concerns, or condition characteristics.

Accordingly, an offer based solely on photographs or submitted information may be revised or withdrawn following physical inspection.

6. OFFERS ARE NOT APPRAISALS

An offer made by NRG Cards represents the amount NRG Cards is willing to pay or provide in trade for a particular Item at a particular time.

An NRG Cards offer is not:

  • an appraisal;
  • a statement of fair market value;
  • an insurance valuation;
  • a guarantee of resale value;
  • an investment recommendation; or
  • a representation that the offered amount is the highest price available elsewhere.

NRG Cards may consider factors including:

  • recent comparable sales;
  • current market demand;
  • inventory levels;
  • expected resale value;
  • liquidity;
  • player or collector demand;
  • condition;
  • grading;
  • grading population;
  • scarcity;
  • transaction costs;
  • marketplace fees;
  • shipping costs;
  • fraud risk; and
  • anticipated holding period.

NRG Cards is not required to disclose its anticipated resale price, profit margin, pricing methodology, or other internal business considerations.

7. CASH VALUE AND TRADE VALUE

NRG Cards may offer different values depending on the type of transaction.

For example, NRG Cards may offer:

  • one amount for a cash purchase;
  • a higher or different amount as trade value; or
  • store credit or another form of consideration.

Trade value is not equivalent to cash value unless expressly stated.

NRG Cards may determine the terms and amount of each offer based on the specific transaction.

8. OFFER EXPIRATION

Sports-card and collectible markets may change rapidly.

Unless otherwise stated, NRG Cards may establish an expiration period for any offer.

An expired offer does not obligate NRG Cards to honor the previously offered amount.

If the market value, condition, availability, or other circumstances materially change before a transaction is completed, NRG Cards may issue a revised offer.

9. PHYSICAL INSPECTION

Items delivered or shipped to NRG Cards may be physically inspected before a transaction is finalized.

Inspection may include review of:

  • authenticity;
  • condition;
  • centering;
  • corners;
  • edges;
  • surface;
  • print defects;
  • creases;
  • dents;
  • stains;
  • scratches;
  • alterations;
  • trimming;
  • recoloring;
  • restoration;
  • autograph authenticity;
  • serial numbering;
  • grading holder integrity;
  • certification information; and
  • other characteristics relevant to the Item.

NRG Cards may also compare an Item against photographs or information supplied during the submission process.

10. REVISED OFFERS

If an Item materially differs from the photographs, description, grade, certification, condition, or other information supplied before inspection, NRG Cards may revise its offer.

Examples include:

  • undisclosed damage;
  • scratches or surface defects;
  • creases;
  • damaged corners or edges;
  • staining;
  • trimming;
  • recoloring;
  • restoration;
  • questionable authenticity;
  • counterfeit autographs;
  • altered cards;
  • incorrect parallels;
  • incorrect serial numbers;
  • damaged graded holders;
  • mismatched certification numbers; or
  • other material discrepancies.

You may accept or decline a revised offer unless the parties have already completed a binding transaction.

11. REJECTED ITEMS

NRG Cards may decline to purchase or trade for an Item for any legitimate business, legal, authenticity, condition, or inventory reason.

An Item may be rejected because it is:

  • counterfeit;
  • suspected counterfeit;
  • altered;
  • damaged;
  • improperly described;
  • outside NRG Cards' purchasing criteria;
  • insufficiently valuable;
  • difficult to authenticate;
  • associated with an ownership concern;
  • subject to fraud concerns; or
  • otherwise unsuitable for NRG Cards' inventory.

A rejected Item remains the property of the submitter unless ownership has otherwise lawfully transferred.

12. AUTHENTICITY

You are responsible for accurately disclosing any known authenticity concerns.

You must disclose any known or suspected:

  • counterfeit card;
  • counterfeit autograph;
  • forged signature;
  • fake patch;
  • altered card;
  • trimmed card;
  • recolored card;
  • restored card;
  • fraudulent grading holder;
  • altered certification label; or
  • other authenticity issue.

NRG Cards may rely on recognized third-party grading or authentication services when evaluating an Item.

A third-party grade or authentication determination remains the opinion or determination of the applicable third party.

13. GRADED CARDS

If you submit a graded or encapsulated card, you represent that the holder, label, certification number, and card contained within the holder have not knowingly been altered, substituted, or fraudulently modified.

NRG Cards may verify certification information with the applicable grading company where such information is available.

NRG Cards does not guarantee that a grading company's opinion will remain unchanged or that another grading company would assign the same grade.

NRG Cards generally will not remove a graded card from its holder during an ordinary purchase evaluation unless separately authorized.

14. RAW CARDS

Raw or ungraded cards are evaluated based on NRG Cards' observations and current purchasing criteria.

NRG Cards does not guarantee that a raw card will receive any particular grade from PSA, SGC, Beckett, CGC, or another grading company.

Any internal assessment by NRG Cards concerning the potential grade or condition of a raw card is an opinion only.

15. ALTERED OR COUNTERFEIT ITEMS

NRG Cards may immediately suspend evaluation of an Item if it reasonably suspects that the Item is:

  • counterfeit;
  • stolen;
  • fraudulently altered;
  • trimmed;
  • recolored;
  • restored without disclosure;
  • associated with falsified documentation; or
  • otherwise connected with potentially unlawful conduct.

Where appropriate or required by law, NRG Cards may retain relevant records and cooperate with grading companies, payment providers, marketplaces, insurers, law-enforcement authorities, or other appropriate entities.

NRG Cards will handle physical Items in accordance with applicable law and will not knowingly participate in the trafficking of stolen or counterfeit property.

16. SHIPPING ITEMS TO NRG CARDS

If you ship Items to NRG Cards, you are responsible for securely packaging the Items unless NRG Cards expressly agrees otherwise.

We strongly recommend:

  • protective card sleeves or holders where appropriate;
  • adequate cushioning;
  • rigid packaging;
  • a sturdy shipping container;
  • tracking;
  • appropriate insurance based on value; and
  • retention of proof of shipment.

You should not write unnecessarily detailed information about valuable contents on the outside of a shipping package.

17. SHIPPING LABELS PROVIDED BY NRG CARDS

NRG Cards may, but is not required to, provide a shipping label.

If NRG Cards provides a label, any available insurance or carrier coverage will be subject to the limits, exclusions, documentation requirements, and claim procedures applicable to that shipment.

Providing a shipping label does not necessarily mean that NRG Cards has accepted ownership of the Items being shipped.

Ownership transfers only as provided in these Submission Terms and the applicable transaction.

18. RISK DURING INBOUND SHIPPING

Risk associated with an Item while it is being transported to NRG Cards depends upon the shipping arrangement, carrier terms, insurance coverage, and applicable law.

Unless NRG Cards expressly agrees otherwise in writing, you remain responsible for selecting an appropriate shipping method and ensuring that the declared value and insurance coverage are sufficient for Items shipped using your own label or carrier account.

NRG Cards is not responsible for loss or damage occurring before NRG Cards receives a shipment where liability may lawfully remain with the sender or carrier.

19. CONFIRMATION OF RECEIPT

Carrier tracking showing “delivered” does not necessarily establish that every Item described by the submitter was contained within a package.

NRG Cards may inspect and inventory packages after receipt.

If the contents received differ from the submission information, NRG Cards' intake records, photographs, video, package weight, security records, or other documentation may be used to investigate the discrepancy.

NRG Cards may use reasonable security measures, including video recording of high-value package intake and inspection.

20. RESPONSIBILITY WHILE ITEMS ARE IN NRG CARDS' POSSESSION

NRG Cards will use commercially reasonable care when handling Items while they are physically in NRG Cards' possession.

No handling or storage system can entirely eliminate the risk of accidental loss or damage.

If an Item is lost or materially damaged as a direct result of NRG Cards' failure to exercise reasonable care while the Item is in its possession, any liability will be determined under applicable law and the circumstances of the transaction.

Nothing in these Submission Terms limits liability that cannot lawfully be limited.

21. ACCEPTANCE OF AN OFFER

An offer may be accepted through the method specified by NRG Cards, including electronic acceptance, email, account functionality, text communication, written agreement, or another clearly communicated method.

Acceptance of an offer constitutes your agreement to sell or trade the identified Items under the stated transaction terms, subject to any remaining inspection, verification, payment, or other expressly disclosed conditions.

22. TRANSFER OF OWNERSHIP

Unless otherwise expressly agreed in writing, ownership of an Item transfers to NRG Cards when:

1. NRG Cards has completed any required inspection or verification;

2. both parties have agreed to the final consideration for the Item; and

3. NRG Cards has issued or tendered the agreed payment, trade consideration, or other agreed consideration.

After ownership transfers, NRG Cards may possess, market, list, grade, authenticate, resell, trade, consign, hold, or otherwise lawfully dispose of the Item.

The former owner has no continuing ownership interest in the Item merely because the Item later increases in value.

23. FINALITY OF COMPLETED SALES TO NRG CARDS

Once you voluntarily accept NRG Cards' final offer, NRG Cards has completed payment, and ownership has transferred, the transaction is generally final.

You may not demand that NRG Cards return the Item because:

  • its market value later increases;
  • NRG Cards resells it for a higher amount;
  • a player subsequently performs well;
  • the Item subsequently receives a favorable grade;
  • another buyer later offers more; or
  • you change your mind.

NRG Cards likewise assumes the market risk that the Item may decline in value after purchase.

24. PAYMENT

NRG Cards may pay for Items using payment methods made available for the transaction.

These may include:

  • check;
  • electronic payment;
  • ACH;
  • digital payment platform;
  • store credit;
  • trade consideration; or
  • another agreed payment method.

You are responsible for providing accurate payment information.

NRG Cards may delay payment for a reasonable period if necessary to complete:

  • inspection;
  • authentication;
  • ownership verification;
  • identity verification;
  • fraud review;
  • certification verification;
  • shipping investigation; or
  • legally required compliance procedures.

25. TAX RESPONSIBILITIES

Payments received from NRG Cards may have tax consequences.

You are responsible for determining and satisfying your own federal, state, and local tax obligations.

NRG Cards may collect taxpayer information or issue tax reporting documents where required by applicable law.

NRG Cards does not provide tax advice.

26. RETURN OF ITEMS WHEN NO TRANSACTION IS COMPLETED

If NRG Cards receives an Item but the parties do not complete a sale or trade, NRG Cards may return the Item according to the shipping arrangement communicated for the submission.

Unless NRG Cards expressly agrees otherwise, return shipping, insurance, or related costs may be the responsibility of the submitter where an Item is rejected or a revised offer is declined.

NRG Cards may require payment of return shipping costs before sending an Item back where those costs are the submitter's responsibility.

27. FAILURE TO RESPOND

If NRG Cards is holding Items because a submitter has not accepted or declined an offer, paid required return shipping, provided requested information, or otherwise completed the submission process, NRG Cards may attempt to contact the submitter using available contact information.

NRG Cards will not automatically acquire ownership of Items solely because a submitter temporarily fails to respond.

Unclaimed property will be handled in accordance with applicable law.

28. MARKET VALUE CHANGES DURING A SUBMISSION

Collectible values may increase or decrease while an Item is being evaluated, transported, authenticated, inspected, or processed.

Unless otherwise agreed in writing, NRG Cards does not guarantee the market value of an Item during the submission process.

A market-value change alone does not create liability or require either party to complete a transaction that has not otherwise become binding.

29. THIRD-PARTY MARKET DATA

NRG Cards may consider information from marketplaces, auction platforms, grading companies, price guides, market-data services, or other sources when evaluating Items.

Such data may contain:

  • delayed information;
  • canceled transactions;
  • unpaid transactions;
  • returns;
  • fraudulent sales;
  • private transactions;
  • incomplete records; or
  • inaccurate information.

NRG Cards therefore does not guarantee that third-party comparable sales or market data represent the exact value of an Item.

30. GRADING OR AUTHENTICATION AFTER NRG ACQUIRES AN ITEM

After NRG Cards acquires ownership of an Item, NRG Cards may choose to have the Item graded, regraded, authenticated, reviewed, conserved where appropriate, or otherwise evaluated.

Any subsequent grade, authentication decision, or increase or decrease in value belongs to NRG Cards as the owner of the Item.

A seller is not entitled to additional compensation merely because NRG Cards later obtains a favorable grading or authentication result.

31. FRAUD PREVENTION

NRG Cards may use reasonable measures designed to detect and prevent fraud, theft, counterfeit merchandise, payment fraud, shipping fraud, identity fraud, and other unlawful conduct.

These measures may include:

  • identification verification;
  • transaction records;
  • photography;
  • video recording;
  • package weight records;
  • carrier records;
  • certification verification;
  • account information;
  • communications;
  • IP or device information where legally permitted; and
  • other reasonable security records.

Information collected for these purposes will be handled in accordance with the NRG Cards Privacy Policy and applicable law.

32. COMMUNICATIONS

By submitting an Item, you authorize NRG Cards to contact you concerning the submission using the contact information you provide.

Submission-related communications may include:

  • receipt confirmations;
  • requests for additional information;
  • offers;
  • revised offers;
  • payment information;
  • shipping information;
  • authenticity questions;
  • transaction updates; and
  • fraud or security communications.

Transactional communications are separate from optional marketing communications.

33. SUBMITTED PHOTOGRAPHS AND INFORMATION

You authorize NRG Cards to use photographs, descriptions, certification information, and other Item-related content you provide as reasonably necessary to:

  • evaluate the submission;
  • verify authenticity;
  • maintain transaction records;
  • prevent fraud;
  • complete a purchase or trade;
  • create inventory records after acquisition; and
  • comply with legal obligations.

NRG Cards will handle personally identifiable information in accordance with its Privacy Policy.

34. PERSONAL PROPERTY LEFT AT NRG CARDS

Items delivered in person to NRG Cards should be accompanied by sufficient identifying and contact information.

NRG Cards is not obligated to store indefinitely Items that are abandoned or left unclaimed.

Any unclaimed Items will be handled in accordance with applicable Ohio unclaimed-property, bailment, and other applicable laws.

Nothing in these Submission Terms authorizes NRG Cards to take ownership of abandoned property in a manner inconsistent with applicable law.

35. NO GUARANTEE THAT NRG WILL PURCHASE AN ITEM

NRG Cards may change its purchasing interests based on inventory, market conditions, capital allocation, customer demand, or business strategy.

Past purchases of a particular player, product, card, category, or price range do not require NRG Cards to purchase similar Items in the future.

An invitation to submit cards does not constitute a promise to purchase them.

36. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NRG CARDS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM A SUBMISSION, INCLUDING LOST PROFITS, LOST APPRECIATION IN VALUE, LOST SALES OPPORTUNITIES, OR MARKET FLUCTUATIONS.

TO THE FULLEST EXTENT PERMITTED BY LAW, IF NRG CARDS IS FOUND LIABLE FOR PHYSICAL LOSS OF OR DAMAGE TO AN ITEM WHILE THE ITEM IS IN NRG CARDS' POSSESSION, NRG CARDS' LIABILITY WILL NOT EXCEED THE REASONABLY ESTABLISHED FAIR MARKET VALUE OF THE ITEM IMMEDIATELY BEFORE THE LOSS OR DAMAGE, TAKING INTO ACCOUNT RELIABLE MARKET DATA AND THE ITEM'S CONDITION.

THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

37. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless NRG Cards and its owners, officers, employees, representatives, and agents from third-party claims, losses, liabilities, damages, and reasonable expenses arising from:

  • your lack of legal ownership of a submitted Item;
  • sale or attempted sale of stolen property;
  • counterfeit or fraudulently altered Items knowingly submitted by you;
  • false ownership representations;
  • infringement of another person's rights;
  • material misrepresentations made during the submission process; or
  • violation of applicable law.

This provision does not require you to indemnify NRG Cards for NRG Cards' own unlawful conduct or liability that cannot legally be shifted.

38. GOVERNING LAW

These Submission Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except where federal law or another jurisdiction's mandatory law applies.

Nothing in these Submission Terms deprives a consumer of protections that cannot lawfully be waived.

39. DISPUTES

If a dispute arises regarding a submission, the parties are encouraged to attempt in good faith to resolve the matter before beginning litigation.

Unless applicable law requires otherwise, judicial proceedings arising from these Submission Terms may be brought in a state or federal court having appropriate jurisdiction in Ohio.

Either party may pursue an eligible claim in small claims court.

Nothing in these Submission Terms prevents either party from reporting suspected unlawful activity to law enforcement or another governmental agency.

40. RELATIONSHIP TO OTHER NRG POLICIES

These Submission Terms supplement the NRG Cards:

  • Terms of Service;
  • Privacy Policy;
  • Cookie Notice;
  • Shipping Policy;
  • Return and Refund Policy; and
  • any transaction-specific agreement expressly accepted by the parties.

If a transaction-specific written agreement expressly conflicts with these Submission Terms, the transaction-specific provision will control for that transaction.

41. CHANGES TO THESE SUBMISSION TERMS

NRG Cards may update these Submission Terms periodically to reflect changes in its submission process, business practices, technology, market conditions, or applicable law.

The “Last Updated” date at the top identifies the most recent version.

Changes apply prospectively unless applicable law permits otherwise.

The version in effect when a submission is initiated will generally govern that submission unless the parties expressly agree otherwise.
