Terms of Service

These Terms of Service (“Terms”) govern your access to and use of nrg-cards.com (the “Site”) and the products, services, features, transactions, and other offerings made available by NRG Cards (“NRG Cards,” “NRG,” “we,” “us,” or “our”).

These Terms apply to purchases from NRG Cards, offers to buy or sell sports cards or other collectibles, trades, card evaluations, account use, communications, promotions, and other interactions with NRG Cards (collectively, the “Services”).

By accessing the Site, creating an account, submitting an order, submitting a card or collection for an offer, accepting an offer, initiating a trade, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy and any other policies expressly incorporated into these Terms.

If you do not agree to these Terms, do not use the Services.

1. ELIGIBILITY

You must be at least 18 years old and legally capable of entering into a binding agreement to independently purchase, sell, or trade through NRG Cards.

Individuals under 18 may use the Services only with the involvement, supervision, and authorization of a parent or legal guardian, to the extent permitted by law.

By entering into a transaction with NRG Cards, you represent that you have the legal capacity and authority to do so.

2. ABOUT NRG CARDS

NRG Cards buys, sells, and trades sports cards, trading cards, memorabilia, collectibles, and related products.

Unless otherwise stated in a particular listing or transaction, products offered for sale directly through the Site are sold by NRG Cards.

NRG Cards is an independent business and is not affiliated with, sponsored by, endorsed by, or officially connected with Major League Baseball, the National Basketball Association, the National Football League, the National Hockey League, NCAA, Fanatics, Topps, Panini, Upper Deck, Bowman, PSA, SGC, Beckett, CGC, or any other league, team, player, manufacturer, grading company, or rights holder merely because its products, marks, names, or grading services are referenced on the Site.

All third-party trademarks and names belong to their respective owners and are used for identification and descriptive purposes.

3. PRODUCT LISTINGS

NRG Cards attempts to provide accurate descriptions, photographs, prices, grades, certification information, serial numbers, and other product information.

However, collectible products are highly individualized, and minor errors may occasionally occur.

Unless otherwise expressly stated, photographs of individual cards are intended to depict the actual card being offered for sale.

You are responsible for reviewing the complete listing, photographs, condition information, grading information, serial numbering, certification numbers, and other details before purchasing.

NRG Cards reserves the right to correct errors, inaccuracies, or omissions and to update or cancel listings before completion of a transaction where appropriate.

4. UNIQUE NATURE OF COLLECTIBLES

You acknowledge that sports cards and collectibles are unique products whose market values may fluctuate substantially.

Values may change because of factors including:

player performance;
injuries;
trades;
retirement;
popularity;
scarcity;
supply and demand;
grading populations;
new product releases;
market conditions;
economic conditions;
collector sentiment; and
other events outside NRG Cards' control.

NRG Cards does not guarantee that any collectible will maintain or increase in value.

A purchase from NRG Cards should not be interpreted as financial, investment, tax, or legal advice.

Any commentary, rankings, market analysis, price information, player analysis, prospect analysis, articles, newsletters, or other editorial content published by NRG Cards is provided for informational and entertainment purposes only.

5. THIRD-PARTY GRADING

Certain cards sold by NRG Cards may have been graded, authenticated, or encapsulated by third-party grading companies such as PSA, SGC, Beckett, CGC, or others.

A grade represents the opinion of the grading company that assigned it.

NRG Cards is not a grading company and does not independently warrant that a third-party grade is correct.

When a graded card is sold, NRG Cards represents the card based upon the grading company's label and certification information available to NRG Cards at the time of listing.

NRG Cards is not responsible for:

differences of opinion regarding a grade;
changes in grading standards;
population-report changes;
a grading company's later decision to modify or revoke a grade;
differences between grading companies;
unsuccessful crossover or regrading attempts; or
a lower grade assigned if a buyer removes a card from its original holder and resubmits it.

Removing a graded card from its original sealed holder may permanently affect any rights associated with a purchase.

Established hobby platforms similarly distinguish authenticity or listing accuracy from the subjective judgment of third-party graders.

6. RAW CARD CONDITION

Unless expressly guaranteed otherwise in writing, NRG Cards does not guarantee that an ungraded or “raw” card will receive any particular grade if submitted to a third-party grading service.

Descriptions such as:

clean;
sharp;
mint-looking;
near mint;
excellent;
strong condition;
grading candidate; or
similar descriptive terminology

are opinions concerning visible condition and are not guarantees of a future numerical grade.

NRG Cards may provide photographs or observations concerning centering, corners, edges, surface, print quality, or other characteristics.

These observations are provided to assist buyers but do not constitute a grading guarantee.

Buyers should evaluate photographs and product descriptions before purchasing.

7. AUTHENTICITY

NRG Cards takes commercially reasonable steps to avoid knowingly purchasing, selling, or trading counterfeit or fraudulently altered collectibles.

However, unless expressly stated otherwise, NRG Cards is not a third-party authentication service.

For cards or memorabilia authenticated by a recognized third party, NRG Cards may rely on the certification, label, holder, documentation, or database information supplied by that third party.

If you believe an item purchased directly from NRG Cards is materially different from the item described or is not authentic, contact NRG Cards promptly at the contact information below.

NRG Cards may require photographs, documentation, return of the item, or third-party review before resolving an authenticity claim.

8. PRICING

All prices displayed on the Site are in U.S. dollars unless otherwise stated.

Prices may change at any time prior to purchase.

Because collectible markets may change rapidly, NRG Cards is not required to honor a price resulting from an obvious typographical, technical, data-entry, or system error.

If a material pricing error is identified after an order is placed but before fulfillment, NRG Cards may cancel the order and refund any amount paid.

NRG Cards may offer different pricing through different channels, marketplaces, card shows, promotions, or negotiated transactions.

9. ORDERS

Submitting an order does not necessarily constitute final acceptance of the order by NRG Cards.

We may decline, cancel, or limit an order where reasonably necessary, including because of:

inventory errors;
duplicate sales;
pricing errors;
suspected fraud;
payment failure;
incorrect product information;
technical malfunction;
legal restrictions; or
other legitimate business or security concerns.

If NRG Cards cancels a paid order, the amount paid for the canceled portion will be refunded.

10. PAYMENT

Payment is due at the time required during checkout or as otherwise agreed for a transaction.

NRG Cards may accept payment through third-party payment processors.

You represent that you are authorized to use the payment method submitted.

You agree to provide current, complete, and accurate billing information.

Transactions may be declined, delayed, or canceled when payment cannot be verified or where fraud or unauthorized activity is reasonably suspected.

11. SALES TAX

Applicable sales, use, or similar taxes may be collected where required by law.

Tax calculations may depend upon factors including the shipping destination, transaction type, marketplace, exemptions, and applicable taxing jurisdiction.

You are responsible for taxes that are legally your responsibility and are not collected by NRG Cards.

12. SHIPPING

Orders will be shipped using the methods and carriers made available by NRG Cards.

Shipping estimates are estimates only and are not guaranteed delivery dates unless NRG Cards expressly states otherwise in writing.

NRG Cards is not responsible for delays caused by carriers, weather, natural disasters, governmental actions, incorrect addresses supplied by customers, or circumstances outside our reasonable control.

Customers are responsible for supplying a complete and accurate shipping address.

NRG Cards may require tracking, insurance, signature confirmation, or other delivery safeguards based on the value or nature of an order.

Additional shipping terms may be described in our Shipping Policy, which is incorporated into these Terms.

13. DELIVERY AND LOST OR DAMAGED PACKAGES

You should inspect packages promptly after delivery.

If an order arrives damaged, appears tampered with, contains the wrong item, or is missing an item, you must notify NRG Cards promptly and provide any requested photographs, packaging, tracking information, or other evidence reasonably necessary to investigate the claim.

Do not discard packaging or shipping materials while a claim is pending.

NRG Cards may require cooperation with a carrier, insurer, payment processor, or law-enforcement agency when investigating lost, stolen, or damaged shipments.

Resolution of a claim may depend upon the facts of the transaction, carrier findings, insurance coverage, and applicable law.

14. RETURNS AND REFUNDS

Returns are governed by NRG Cards' posted Return and Refund Policy in effect at the time of purchase.

Because sports cards and collectibles may have rapidly changing market values and may be unique, limited, numbered, graded, sealed, or otherwise condition-sensitive, certain products may be final sale where clearly disclosed and permitted by applicable law.

Nothing in these Terms eliminates any right or remedy that cannot lawfully be waived.

An approved return must include the same item originally purchased and must be returned in substantially the same condition in which it was received.

For graded cards, the original holder, label, certification, tamper-evident features, and other components must remain intact.

NRG Cards may deny a return or refund where an item has been substituted, altered, damaged after delivery, removed from its graded holder, resealed, modified, or otherwise materially changed after receipt, to the extent permitted by law.

15. SEALED PRODUCTS

If NRG Cards sells unopened boxes, packs, cases, mystery products, or other sealed products, the contents of those products are inherently uncertain.

NRG Cards does not guarantee:

particular players;
particular cards;
autographs;
parallels;
numbered cards;
inserts;
case hits;
grading outcomes;
resale value; or
financial return

unless a particular result is expressly guaranteed in the product listing.

Dissatisfaction with the contents or market value of an otherwise authentic, unopened product does not by itself mean the product was defective or misrepresented.

16. SELLING CARDS TO NRG CARDS

NRG Cards may allow individuals to submit cards or collections for evaluation or purchase.

Submitting cards, photographs, information, or a collection to NRG Cards does not require NRG Cards to make an offer.

Any initial estimate or preliminary offer based upon photographs or descriptions may be subject to physical inspection and verification.

NRG Cards may consider factors including:

authenticity;
condition;
market demand;
recent comparable sales;
liquidity;
grading;
population reports;
inventory needs;
transaction costs; and
anticipated resale value.

NRG Cards is not required to offer any particular percentage of a collectible's estimated retail value or recent comparable sales.

17. SELLER REPRESENTATIONS

When you sell, offer, or trade an item to NRG Cards, you represent and warrant that:

you are the lawful owner of the item or are legally authorized by the owner to transfer it;
you have the unrestricted legal right to sell or trade the item;
the item is not stolen;
the item is not counterfeit;
you have disclosed known material alterations or defects;
information you provide regarding the item is accurate to the best of your knowledge;
no other person has a lien, ownership claim, security interest, or superior right in the item; and
the transaction does not violate applicable law.

You must disclose any known material issue involving authenticity, alteration, trimming, restoration, recoloring, counterfeit signatures, fraudulent certification, or other condition that could materially affect the collectible's identity or value.

18. STOLEN OR FRAUDULENT PROPERTY

NRG Cards does not knowingly purchase stolen or unlawfully obtained property.

If NRG Cards reasonably suspects that an item may be stolen, counterfeit, fraudulently altered, or otherwise connected with unlawful activity, NRG Cards may suspend or terminate the transaction and may preserve relevant information or cooperate with law enforcement as permitted or required by law.

NRG Cards may require identification or additional ownership information for certain transactions.

19. INSPECTION OF ITEMS SOLD TO NRG CARDS

An offer may be conditioned upon NRG Cards receiving and inspecting the item.

If the item materially differs from photographs, descriptions, grades, certification numbers, condition representations, or other information provided before shipment, NRG Cards may:

revise its offer;
decline the transaction; or
return the item.

NRG Cards will not intentionally damage a collectible in order to evaluate it.

Unless separately agreed in writing, NRG Cards will not remove a graded card from its holder as part of an ordinary purchase evaluation.

20. ACCEPTANCE OF AN NRG PURCHASE OFFER

An offer from NRG Cards is not binding indefinitely unless a specific expiration period is stated.

Sports-card values may change rapidly. NRG Cards may therefore place an expiration date or acceptance period on offers.

A transaction becomes final when the applicable offer is accepted and any required inspection, verification, documentation, delivery, and payment conditions have been satisfied.

Once NRG Cards has paid for and acquired title to an item, the seller generally may not demand return of the item merely because its subsequent market value increases.

21. PAYMENT TO SELLERS

NRG Cards may pay sellers using the payment methods made available for the transaction.

You are responsible for supplying accurate payment information.

NRG Cards may delay payment where reasonably necessary to:

verify identity;
verify ownership;
inspect the item;
investigate suspected fraud;
confirm authenticity;
resolve shipping issues; or
comply with law.

Any applicable tax-reporting obligations will be handled according to applicable law.

22. SHIPPING CARDS TO NRG CARDS

If you ship cards or collectibles to NRG Cards, you are responsible for packaging them in a manner reasonably designed to protect them during transit.

Unless NRG Cards provides a shipping label or expressly agrees otherwise, you are responsible for selecting the carrier, shipping method, tracking, and insurance.

Risk associated with shipping a card to NRG Cards may depend upon the shipping arrangement used and applicable law.

You should retain tracking information and proof of shipment until the transaction is complete.

23. TRADES

NRG Cards may offer customers the ability to trade collectibles.

Trade values may differ from cash purchase values.

For example, NRG Cards may offer:

one amount as a cash purchase offer; and
a different amount as trade credit or trade value.

Such differences reflect the economics of the transaction and do not necessarily represent an appraisal or statement of fair market value.

A trade is final after both parties agree to the specific items and values and all required inspections and transfers have been completed, subject to applicable law and any expressly stated return rights.

24. OFFERS AND NEGOTIATIONS

If the Site permits users to submit purchase offers or negotiate prices, submitting an offer does not automatically create a completed sale unless the interface or transaction expressly states otherwise.

NRG Cards may accept, decline, or counter an offer.

An accepted offer may expire if payment is not completed within the stated period.

Repeated bad-faith offers, fraudulent payment attempts, manipulation, harassment, or abuse of offer functionality may result in restrictions or account termination.

25. CARD VALUES, COMPARABLE SALES, AND MARKET INFORMATION

NRG Cards may display estimated values, recent sales, market trends, rankings, indices, scores, pricing information, or comparable transactions.

Such information may come from third parties, public sources, proprietary analysis, historical data, or combinations of sources.

Market data may be incomplete, delayed, incorrect, or affected by transactions that are later canceled, returned, manipulated, or otherwise unreliable.

Accordingly, market information should be considered an informational tool rather than a guarantee of actual market value.

NRG Cards does not guarantee that you can buy or sell an item at any displayed, estimated, or historical value.

26. NRG OPENING BELL AND EDITORIAL CONTENT

NRG Cards may publish articles, rankings, newsletters, videos, social-media content, prospect analysis, market commentary, price analysis, and other editorial material, including content under the NRG Opening Bell name.

Such content represents opinions and analysis based upon information available at the time of publication.

It is not financial, investment, legal, tax, or professional advice.

NRG Cards may own or hold inventory involving players, cards, sets, manufacturers, or categories discussed in its editorial content.

You should make your own collecting and purchasing decisions.

27. ACCOUNTS

Certain Services may require an account.

You agree to provide accurate information and keep your account information current.

You are responsible for maintaining the confidentiality of your credentials and for activity conducted through your account to the extent permitted by law.

Notify NRG Cards promptly if you suspect unauthorized account access.

You may not:

impersonate another person;
create accounts using false information for fraudulent purposes;
attempt to access another person's account;
circumvent account restrictions; or
use automated means to create or abuse accounts without authorization.

28. PROHIBITED USE

You may not use the Site or Services to:

violate any applicable law;
commit or facilitate fraud;
sell or trade stolen or counterfeit items;
infringe intellectual-property rights;
submit false or misleading information;
attempt unauthorized access to systems or accounts;
introduce malware or harmful code;
interfere with Site operation;
scrape, harvest, copy, or extract Site data through unauthorized automated means;
manipulate pricing, offers, reviews, rankings, or market data;
harass, threaten, or abuse another person;
impersonate NRG Cards or another person;
conduct fraudulent chargebacks; or
use the Services for unlawful purposes.

NRG Cards may suspend or terminate access where reasonably necessary to protect the business, customers, Site, or third parties.

29. USER CONTENT

If you provide photographs, reviews, comments, feedback, submissions, or other content to NRG Cards (“User Content”), you retain any ownership rights you may have in that content.

You grant NRG Cards a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and use User Content as reasonably necessary to operate the Services, process the applicable transaction, provide customer service, prevent fraud, and otherwise fulfill the purpose for which the content was submitted.

If NRG Cards wants to use a customer's photograph, testimonial, or other identifiable content for unrelated advertising or promotional purposes, NRG Cards may seek additional permission where appropriate or required.

You represent that you have the right to provide the User Content you submit.

30. INTELLECTUAL PROPERTY

The Site and its original content, branding, graphics, logos, software, design, text, databases, market analysis, rankings, and other materials are owned by NRG Cards or its licensors and are protected by applicable intellectual-property laws.

Nothing in these Terms transfers ownership of NRG Cards intellectual property to you.

You may use the Site for personal, lawful purposes.

Without prior written permission, you may not reproduce, distribute, republish, sell, commercially exploit, systematically scrape, create a competing database from, or otherwise misuse NRG Cards' proprietary content.

31. THIRD-PARTY SERVICES

The Site may integrate with or link to payment processors, shipping carriers, social-media platforms, grading companies, analytics services, marketplaces, or other third-party services.

NRG Cards does not control those third parties.

Your use of third-party services may be subject to their separate terms and privacy policies.

NRG Cards is not responsible for the independent acts or omissions of a third-party provider except to the extent liability cannot legally be excluded.

32. PROMOTIONS AND GIVEAWAYS

Sweepstakes, contests, giveaways, and other promotions may be subject to separate official rules.

If separate promotion rules conflict with these Terms regarding a specific promotion, the promotion rules will control for that promotion.

No purchase will be required to enter a sweepstakes where prohibited by law or where applicable rules require a no-purchase method of entry.

33. CHARGEBACKS AND PAYMENT DISPUTES

If you believe a transaction is incorrect, unauthorized, defective, or otherwise disputed, you are encouraged to contact NRG Cards promptly so that we have an opportunity to investigate and resolve the matter.

Nothing in these Terms prevents you from exercising legitimate rights provided by your card issuer, payment provider, or applicable law.

However, knowingly submitting false information in connection with a chargeback, falsely claiming that an item was not received, substituting a different item, or otherwise attempting to obtain both the merchandise and the purchase price may constitute fraud.

NRG Cards reserves the right to provide transaction records, tracking information, photographs, communications, account records, and other relevant evidence to payment processors, financial institutions, insurers, law enforcement, or other appropriate parties when responding to a dispute.

34. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE, SERVICES, AND INFORMATION PROVIDED THROUGH THEM ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, EXCEPT FOR EXPRESS WARRANTIES OR REPRESENTATIONS SPECIFICALLY MADE BY NRG CARDS IN WRITING.

NRG CARDS DOES NOT WARRANT THAT:

THE SITE WILL ALWAYS BE AVAILABLE OR ERROR-FREE;
MARKET INFORMATION WILL ALWAYS BE COMPLETE OR ACCURATE;
A COLLECTIBLE WILL INCREASE OR MAINTAIN ITS VALUE;
A RAW CARD WILL RECEIVE A PARTICULAR GRADE;
A THIRD-PARTY GRADE WILL NEVER CHANGE; OR
THIRD-PARTY SERVICES WILL OPERATE WITHOUT INTERRUPTION.

THIS SECTION DOES NOT DISCLAIM WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED.

35. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NRG CARDS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE SERVICES OR A TRANSACTION, INCLUDING LOST PROFITS, LOST OPPORTUNITY, LOST APPRECIATION IN VALUE, OR LOSS OF DATA, WHERE SUCH DAMAGES MAY LAWFULLY BE EXCLUDED.

TO THE FULLEST EXTENT PERMITTED BY LAW, NRG CARDS' AGGREGATE LIABILITY ARISING FROM A PARTICULAR PURCHASE, SALE, OR TRADE WILL NOT EXCEED THE AMOUNT PAID TO OR BY NRG CARDS IN CONNECTION WITH THE TRANSACTION GIVING RISE TO THE CLAIM.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

36. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless NRG Cards and its owners, officers, employees, representatives, and agents from third-party claims, losses, liabilities, damages, and reasonable expenses arising from:

your violation of these Terms;
your violation of applicable law;
your infringement of a third party's rights;
your sale or attempted sale of stolen, counterfeit, or unlawfully obtained property;
fraudulent information supplied by you; or
your misuse of the Services.

This provision does not require a consumer to indemnify NRG Cards for NRG Cards' own unlawful conduct or for liability that cannot legally be shifted.

37. ASSUMPTION OF MARKET RISK

You acknowledge that collectibles are speculative and can experience substantial changes in market value.

NRG Cards is not responsible merely because:

a card decreases in value after purchase;
a card increases in value after you sell it;
a player is injured, demoted, traded, suspended, or retires;
market demand changes;
a manufacturer's release affects scarcity;
grading populations change; or
a more favorable transaction becomes available later.

A change in market value after a properly completed transaction does not by itself provide a basis to undo the transaction.

38. GOVERNING LAW

These Terms and disputes arising out of or relating to them are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except where federal law or another jurisdiction's mandatory consumer-protection law applies.

Nothing in these Terms deprives a consumer of non-waivable protections provided by applicable law.

39. DISPUTE RESOLUTION AND VENUE

Before filing a lawsuit concerning a transaction, the parties are encouraged to attempt in good faith to resolve the dispute by contacting the other party and providing a reasonable description of the issue and requested resolution.

Unless applicable law requires otherwise, any judicial proceeding arising from these Terms or the Services may be brought in a state or federal court having appropriate jurisdiction in Ohio.

Nothing in this section prevents either party from pursuing a claim in small claims court where eligible.

Nothing in these Terms restricts any right to report conduct to a governmental or regulatory agency.

40. NO WAIVER

NRG Cards' failure to enforce a provision of these Terms on one occasion does not waive its right to enforce that provision or another provision in the future.

41. SEVERABILITY

If a court or other tribunal with appropriate authority determines that a provision of these Terms is invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where appropriate, and the remaining provisions will remain in effect.

42. ASSIGNMENT

You may not assign your rights or obligations under these Terms without NRG Cards' prior written consent.

NRG Cards may assign these Terms in connection with a merger, acquisition, sale of assets, restructuring, or similar business transaction, subject to applicable law.

43. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any policies or transaction-specific terms expressly incorporated by reference, constitute the agreement between you and NRG Cards concerning the Services addressed by those documents.

Transaction-specific written agreements may supplement these Terms.

If an expressly agreed transaction-specific provision conflicts with these Terms, the transaction-specific provision will control for that transaction.

44. CHANGES TO THESE TERMS

NRG Cards may update these Terms periodically to reflect changes to the Services, business practices, policies, technologies, or applicable law.

The “Last Updated” date at the top will identify the most recent revision.

Changes will apply prospectively unless applicable law permits otherwise.

If required by law, NRG Cards will provide additional notice of material changes.

Your continued use of the Services after revised Terms become effective constitutes acceptance to the extent permitted by applicable law.
